Medical Debt Attorney Long Island

Garnishment Is Banned. Lawsuits Still Happen.

In 2022, New York banned wage garnishment and liens on your primary home to collect medical debt judgments. That's real protection, and plenty of Long Islanders hear it and relax. Then a summons arrives.

Hospitals, doctors, and collectors can still call, mail, and sue. The state has said more than 50,000 New Yorkers were sued over medical debt in a five-year span. On Long Island, that means your neighbors are facing these lawsuits right now.

As a medical debt lawyer serving Nassau and Suffolk, we step in before a bill becomes a judgment. We check the bill, find out who is really suing, and choose the path that fits: dispute it, negotiate it, or discharge it.

Ask our team
Can a hospital sue me for unpaid medical bills in Nassau or Suffolk County?

Yes. Hospitals and doctors can sue over an unpaid bill. New York has said more than 50,000 residents were sued over medical debt in a five-year stretch, and Long Island residents are part of that number. New York does set limits. A hospital or licensed provider generally has three years from the date of treatment to sue, and a medical debt judgment can't be collected by garnishing your wages or placing a lien on your primary home. A summons still demands a response, though. If you've received one, call a medical debt lawyer on Long Island before the deadline to answer passes.

What is the statute of limitations on medical debt in New York?

For hospitals and licensed health care professionals, the general rule is three years from the date of treatment under CPLR § 213-d. That's shorter than the usual six years for contract claims. The rule likely applies to treatment on or after April 3, 2020, so a bill from 2022 or 2023 may be nearing the end of that window. Two cautions: a payment plan or acknowledging the debt may restart the clock, and a bill charged to a credit card can follow different rules. Check the date with a medical debt attorney in Nassau or Suffolk before you send a dollar.

Should I ignore a medical debt summons if they can't garnish my wages?

No, and this is where people get hurt. New York's ban on wage garnishment for medical debt judgments sounds like a reason to relax, but the lawsuit can still go forward. If you don't answer, the other side can ask for a default judgment without ever hearing your version, and a judgment still matters. Answering on time keeps your options open. Our medical debt defense lawyer team on Long Island can respond to the complaint, hold the other side to proof, and look for defenses like an expired deadline or a wrong amount.

Will medical debt show up on my credit report in New York?

It's much less likely than it used to be. A 2023 New York law prohibits providers, hospitals, and ambulance services from reporting medical debt to the credit bureaus. The details can shift with the type of debt, though. Medical bills put on a credit card are generally treated as ordinary consumer debt, and the card issuer may report it. If a medical collection is already on your report, or a collector says it's coming, talk to someone first. With medical debt relief on Long Island, we can check what's being reported and by whom, then decide what to dispute.

Is it worth hiring a hospital bill lawyer on Long Island for a small bill?

Often, yes, because small bills still turn into lawsuits. In recent hospital suits against New Yorkers, the average debt was about $5,700. That's not a fortune, but it's enough to hurt a household already stretched by a mortgage, taxes, and a high deductible. A medical bill debt lawyer in Nassau or Suffolk can check whether the bill is correct, help you apply for the financial assistance New York hospitals must offer, and tell you honestly if paying is the right call. Your first call with our hospital bill lawyer team on Long Island is free, so you can find out before you commit to anything.

Can medical debt be discharged in bankruptcy, and will you push me toward it?

Sometimes, and no. Medical debt is generally unsecured, so it may be wiped out in Chapter 7 or reorganized in Chapter 13, filed in the Eastern District of New York for Long Island residents. But bankruptcy is one of three paths, not the starting point. We also defend lawsuits and handle medical debt negotiation across Long Island, so if a dispute or a settlement solves your problem with less disruption, we'll say so. If bankruptcy truly fits, we'll explain it plainly. Call 516-246-5577 to talk with a medical debt lawyer serving Nassau and Suffolk.
