Proof Behind the Phone Call

A Real Attorney, Every Step

You work directly with an attorney, not a paralegal or case manager, and every step gets explained in plain English.

Lender-Side Experience

Thomas J. Frank has represented lenders, borrowers and bankruptcy trustees, so he knows how the other side builds its case.

Nassau and Suffolk Courts

We know how Suffolk County cases usually unfold and how Nassau County courts handle them, so you know what's coming.

Honest Odds, No Guarantees

Some homes can be saved and others can't. We tell you honestly where you stand before you decide anything.

Foreclosure Defense Lawyer Long Island

In New York, Foreclosure Is a Lawsuit

In New York, a lender can't just take your home. It has to sue you in court, and that lawsuit comes with notice rules, deadlines and defenses most homeowners never hear about.

At The Frank Law Firm P.C., we act as your foreclosure defense lawyer on Long Island, and our foreclosure defense services start with the lender's paperwork. We check whether the required 90-day notice went out, whether the bank can prove it owns your loan, and whether its numbers hold up. Then we look at your finances to find what fits: defending the case, a loan modification, or selling on your terms.

A person in a suit sits at a desk with a wooden house model, a gavel, and scales of justice, suggesting a legal or real estate consultation. Sunlight streams through a window in the background.
Talk through your options

Prevent Foreclosure Long Island

Time to Breathe, and a Plan

A solid defense can slow things down enough for you to make a real decision instead of a desperate one.
You'll know exactly where your case stands, because every court date and filing gets explained to you in plain English.
The lender's notice, ownership papers and payment history get checked for mistakes before you agree to anything.
You may end up with a lower monthly payment through a loan modification, if your numbers support one.
If keeping the house isn't realistic, you can sell on your own terms instead of watching it go to auction.
You stop dreading the mail, because someone is watching every deadline and responding to the lender's attorneys for you.
Bankruptcy stays available for when it truly fits, not as the automatic answer for everyone.

Ask our team
How long do I have to respond to a foreclosure summons in New York?

As little as 20 days if the papers were handed to you personally, and 30 days if they were served another way, such as by mail or on someone at your home. Don't count on a phone call to the bank's lawyer or a pending loan modification application to buy you time. Neither one is a formal answer, and missing the deadline can lead to a default judgment. If you've been served on Long Island, call us right away at 516-246-5577 and we'll read your papers and tell you the real date.

Can a lawyer stop foreclosure on Long Island without filing for bankruptcy?

Often the case can be defended or resolved without bankruptcy, but no honest attorney will promise it. Foreclosure on Long Island is a lawsuit, so we look for problems in the lender's case, such as a missing or defective 90-day notice, trouble proving it owns your loan, or errors in the payment history. We also pursue loan modifications, repayment plans, short sales and deeds in lieu. Bankruptcy, including Chapter 13 to catch up on missed payments over time, is one more tool. We recommend it only when it truly fits your situation.

How long does a foreclosure take in New York before my home is sold?

Often well over a year. Our own estimate is about 15 months from the first missed payment to auction, and another Long Island firm cites an average of 445 days. Every case is different, and we can't promise a timeline. Court calendars, the settlement conference and the lender's own mistakes all move the dates. Your home isn't gone until a court orders a sale and it actually happens. A long timeline only helps if you use it, so the sooner you call about stopping foreclosure on Long Island, the more options you keep.

What is a foreclosure settlement conference, and does it stop the case?

For many owner-occupied one- to four-family homes, the court schedules a settlement conference within about 60 days of proof of service. You, your lawyer and the lender's attorney sit down, and the lender has to negotiate in good faith. Loan modification is a main topic. The conference doesn't end the case on its own, and it doesn't replace your answer to the complaint. Still, it's one of the best chances to work out a payment you can handle. If you want to fight foreclosure on Long Island, we prepare you beforehand and attend with you.

Is foreclosure still common on Long Island, or am I an exception?

You're far from alone. Suffolk County had 933 first-time foreclosure filings in 2024, the most of any county in the New York metro area, and Nassau County had 567, according to PropertyShark. In the second quarter of 2025, Nassau was the metro's busiest market with 173 filings, up 31% from a year earlier, while Suffolk fell sharply. The numbers move around, but thousands of Long Island families face this every year. Many of them paid on time for years until life got in the way.

What does a stop foreclosure attorney on Long Island cost, and how do fees work?

Fees depend on what your case needs, and we won't quote a number before we've seen your papers. What we will do is explain how our fees work in plain terms at the start, so nothing surprises you later. Clients have said we were upfront about costs. Be wary of any company that wants a large payment up front to "rescue" your home with a loan modification, and of any lawyer who guarantees results. Call 516-246-5577 and ask us directly.
